Privacy Policy
This is a working draft that is still being reviewed by an Australian lawyer. Details in [square brackets] will be completed before launch. Questions: lendmeau@gmail.com
This Privacy Policy explains how LendMe Australia Pty Ltd handles personal information when you use the LendMe website, app and peer-to-peer item rental services. It applies to borrowers, lenders, account holders, people who contact us and visitors to our online services. Please read it together with the LendMe Terms and Conditions.
We aim to handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) where they apply to us. Some small businesses are exempt, but exceptions apply. We will confirm our legal coverage and maintain this policy to the standard of the APPs.
1. Who we are and how to contact us
LendMe Australia Pty Ltd (ACN [insert ACN]; ABN [insert ABN]) operates the LendMe platform. For privacy questions, access or correction requests, or complaints, contact us at lendmeau@gmail.com or write to [insert current company mailing address].
2. Personal information we may collect
The information we collect depends on how you use LendMe. It may include:
- account and contact details, such as your name, username, email address, phone number, date of birth and residential or pickup address;
- identity and eligibility information, such as verification results and, if a verification provider requires it, identity document details or a selfie. Where possible, we receive a pass/fail result or limited verification data rather than retaining full identity documents;
- rental information, including listings, booking dates, item condition photos, handover and return records, messages, reviews, incident reports, bond and damage dispute evidence, and customer support communications;
- payment and transaction information, such as amounts, refunds, payout details, payment status and limited card information. Card data may be collected and held directly by our payment provider; we do not claim to store full card numbers unless this is confirmed;
- device and usage information, such as IP address, device identifiers, app and browser type, operating system, log data, approximate location, cookie identifiers and interactions with our website or app;
- information you choose to provide in surveys, feedback, promotions or support requests, and information we receive from payment, identity, fraud prevention or other service providers.
3. How we collect information
We collect information directly from you when you register, create a listing, make or accept a booking, communicate with another user, submit a report or contact support. We also collect some information automatically through the website or app and may receive information from payment processors, identity verification providers, analytics providers, fraud prevention services and other users involved in a booking. Where we collect information from another source, we take reasonable steps to make sure you know about it when required by law.
4. Why we use information
We use personal information for purposes connected with operating a rental marketplace, including to:
- create and administer accounts, verify users where appropriate, and provide platform features;
- publish listings, facilitate bookings, process payments and payouts, and administer any bond or payment dispute process described in the Terms;
- enable users to communicate, arrange handovers, record item condition and resolve complaints, damage, loss, theft or safety reports;
- provide support, send service notices, maintain security, detect and investigate suspected fraud, misuse or unlawful activity, and enforce our terms and policies;
- operate, maintain, analyse and improve our services, including testing features and understanding usage trends;
- send marketing where permitted by law and in accordance with your preferences;
- meet legal, regulatory, tax, reporting and record-keeping obligations, respond to lawful requests, and establish, exercise or defend legal claims.
If you do not provide information needed for a booking, verification, payment or safety investigation, we may be unable to provide the relevant service or feature.
5. When we share information
We may share personal information where reasonably needed for the purposes above, including with:
- other users involved in a booking, such as the name and contact or pickup details needed to arrange a handover. We ask users to keep this information confidential and use it only for the booking;
- payment processors, identity verification providers, cloud hosting, customer support, communications, analytics, fraud prevention and other technology providers that help operate LendMe;
- professional advisers, insurers or claims administrators where needed for advice, risk management or a reported incident;
- law enforcement, regulators, courts, government agencies or other parties where required or authorised by law, or where reasonably necessary to protect safety or our legal rights;
- a purchaser or successor if our business or relevant assets are reorganised, sold or transferred, subject to applicable privacy requirements.
We do not sell personal information. We do not share information with third parties for their own direct marketing unless you have agreed or the law otherwise permits it.
6. Overseas handling
Some providers may store or process information outside Australia. The countries depend on the services we use and may change. Before publication, we will identify the countries in which our current providers handle information and name them here where required. Where the APPs apply, we take reasonable steps required by APP 8 before disclosing personal information to an overseas recipient, including assessing the recipient and the protections available.
7. Cookies, analytics and location
Our website and app may use cookies, software development kits and similar technologies for essential functions, security, preferences, analytics and (where enabled) advertising. You can manage cookies in your browser, although disabling some may affect site functions. The app may request access to your camera or photos so you can upload listing or condition images, and to location services so you can find nearby listings. You can change device permissions, but some features may not work without them. We will identify any analytics or advertising services currently used in the publication checklist before this policy is published.
8. Security and retention
We use reasonable administrative, technical and organisational safeguards designed to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. No online service can guarantee absolute security. If a data breach occurs, we will assess and respond to it, including notifying affected individuals and the OAIC where the Notifiable Data Breaches scheme requires notification.
You can delete your account yourself from your Profile. Deleting removes your name, photo, bio, suburb, listings and identity verification status and disables your login. Where you have unfinished bookings or open reports, the request is reviewed by us first. We may keep booking, payment, message, report and dispute records, with your personal details removed where practicable, where needed for the purposes below.
We keep personal information for as long as reasonably needed for the purposes described in this policy, including to complete transactions, resolve disputes, meet legal and tax obligations, and maintain security records. We then take reasonable steps to destroy or de-identify it, unless we must retain it by law or need it for a permitted purpose. Retention periods should be set in an internal schedule.
9. Access and correction
You may ask us for access to personal information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. Contact us using the details in section 1. We may need to verify your identity and may refuse a request in circumstances permitted by law. If we refuse, we will explain why and how you can complain, where required.
10. Marketing
We may send service messages needed to operate your account or bookings. We will send commercial electronic marketing only in accordance with the Spam Act 2003 (Cth), including consent and unsubscribe requirements. You can unsubscribe using the link in the message or contact us. Unsubscribing from marketing will not stop essential service or transaction messages.
11. Children
LendMe accounts and rentals are for people aged 18 or over. We do not knowingly create accounts for children. If you believe a child has provided personal information to us, contact us so we can assess and take appropriate steps.
12. Privacy complaints
Contact us using the details in section 1 with a description of your concern and how you would like us to resolve it. We will acknowledge and investigate the complaint and respond within a reasonable time. If you are not satisfied, you may be able to complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
13. Automated decisions
Some account, payment, fraud-prevention or safety services may use computer programs to assess information. Before publication, LendMe will confirm whether any automated process makes, or substantially informs, a decision that could significantly affect a person’s rights or interests. If the Australian Privacy Principles require it, this policy will describe the kinds of personal information used and the kinds of decisions made through those processes. We will update this section before the relevant legal requirements commence on 10 December 2026.
14. Changes to this policy
We may update this policy as our services, providers or legal obligations change. We will publish the current version with its updated date. If a change materially affects how we handle information, we will take reasonable steps to notify affected users. Continued use does not replace any consent or notice required by law.
